Terms and Conditions
1. . Activities Operator and the Contract

a) All Activities including courses (collectively defined as “Activities(s)”) are operated by” / “We”). Matthew George Fox T/A MotoFox Rider Experiences, 17 Glen Park Gardens, Bristol, BS5 7NE- The Participant(s) is / are the person(s) listed booking form (“Participant(s)” / “You”).
b) MotoFox Rider Experiences reserves the right to decline any booking at their discretion. The Participant(s) are required to complete a completed Booking Form and agree to our Booking Conditions and Acknowledgment of Risk. These documents form the basis of your contract with MotoFox Rider Experiences. Please read them carefully. Once these documents have been agreed to and the Participant(s) balance or deposit has been paid a contract is then made between MotoFox Rider Experiences and the Participant(s).
c) Variation of the terms of this contract is only valid if done so in writing and signed by both the Participant(s) and an authorised representative of MotoFox Rider Experiences. The contract and all matters arising from it are subject to English law and the exclusive jurisdiction of the English Courts. In the event that any of the provisions of this contract shall be determined by any Court to be invalid, unlawful or unenforceable to any extent then such provision shall to that extent be severed from the remaining provisions of the contract, which shall continue to be valid and enforceable.

2. Payment
​​
a) Payments may be made online through this website (www.MotoFoxUK.com) or by electronic bank transfer (bank transfer by prior arrangement only). For electronic transfer, we will notify the Participant(s) of our bank details via an invoice to raise an invoice we will need a valid postal address and email address.
b)

Full payment is required to secure your place on any single day experience or those with up to 2 overnight stays. Until full payment is received the booking is not confirmed.

Within 10 days prior to the start of the course, no refund will be awarded.

Greater than 10 days, refund request will be awarded with 10% deducted as an administration fee.

If the participant has booked an experience where costs are not recoverable from 3rd party providers the costs will be deducted from the refund balance.

Should the participant wish to rearrange a booking they should in the first place contact MotoFox Rider Experiences via email (MotoFoxUk@gmail.com), if there are more than 10 day until you experiences is due to start a rearrangement will be made at on cost to the participant.

Should a participant wish to transfer their booking to another participant, this can be done up to 10 days before the activity at no cost provided the new participants meets and agrees to the terms set out here.

Any Experience that involves overseas travel or 3 or more nights accommodation where a £100 deposit which is non refundable will be taken at the point of booking.

Full payment will be required on the first day of the calendar month previous to departure. Once full payment is taken for an international tour or domestic tour involving more than 3 nights accomodation it is deemed non refundable and if you decide to cancel no refund or benefit in kind is likely to be issued.​

Should the Participant(s) balance not be paid on the due date, we reserve the right to cancel the Participant(s) reservation and no refund will be made. Should the Participant(s) make a booking after the first day of calendar prior to departure the full amount is due immediately.

Deposits and stage payments paid are specific to the Activities booked and are non-refundable and non-transferable.

Courses are invoiced one month prior to the course start date and on receipt of the full payment your position on the course is secured. If you wish to cancel your place you will need to notify: MotoFoxUK@gmail.com

MotoFox Rider Experiences is not Liable for any payments made by the participant directly to 3rd party providers, including accommodation or travel expenses. It is recommended that you have valid travel insurance in place upon booking to cover these expenses should unforeseen circumstances arise.
3. Surcharges
​
The price of your confirmed Activity is subject at all times to variations in:
a) transportation costs, including the cost of fuel; or
b) dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports; or
c) the exchange rates used to calculate your arrangements;
MotoFox Rider Experinces will absorb and you will not be charged for any increase equivalent to 2% of the price of your travel arrangements, which excludes insurance premiums and any amendment charges and/or additional services or travel arrangements. You will be charged for the amount over and above that, plus an administration charge of £1.00 per person. If this means that you have to pay an increase of more than 10% of the price of your confirmed travel arrangements (excluding any insurance premiums, amendment charges and/or additional services or travel arrangements), you will have the option of accepting a change to another Activity if we are able to offer one (if this is of equivalent or higher quality you will not have to pay more but if it is of lower quality you will be refunded the difference in price), or cancelling and receiving a full refund of all monies paid to us, except for any insurance premiums and any amendment charges and/or additional services or travel arrangements.
Should you decide to cancel for this reason, you must exercise your right to do so within 14 days from the issue date printed on your final invoice. There will be no change made to the price of your confirmed holiday within 30 days of your departure nor will refunds be paid during this period. Should the price of your holiday go down due to the changes mentioned above, by more than 2% of your confirmed holiday cost, then any refund due will be paid to you. However, please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of your travel due to contractual and other protection in place.

4. Special Requests
​
Any special requests must be advised to us at the time of booking e.g. diet, room location, a particular facility at a hotel etc. You should then confirm your requests in writing. Whilst every effort will be made by us to try and arrange your reasonable special requests, we cannot guarantee that they will be fulfilled. The fact that a special request has been noted on your confirmation invoice or any other documentation or that it has been passed on to the supplier is not confirmation that the request will be met. Failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed. We do not accept bookings that are conditional upon any special request being met.

5. 3rd Party Providers
​
Transport, Accommodation or Excursions or other Activities that you may choose to book or pay for whilst you are on the Activities are not part of your contracted arrangements with us, this also applies to any arrangement made in advance of the activities that were booked directly with a 3rd party and not MotoFox Rider Experiences. Where you purchase that excursion through MotoFox Rider Experiences, you do so on the understanding that we are acting as agent on behalf the operator of the excursion. Therefore, your contract will be with the operator of the excursion and not with us. We are not responsible for the provision of the excursion or for anything that happens during the course of its provision by the local operator.

6. Accuracy
​
We endeavour to ensure that all the information and prices both on our website and in our brochures are accurate, however occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances. You must check the current price and all other details relating to the arrangements that you wish to book before your booking is confirmed.

7. Nature of the Activities and Acceptance of Risk
​
​Your booking is accepted on the understanding that you:

Agree that motorcycling is a fun and enjoyable activity, but it is not without inherent risk of serious injury or death. Taking part in MotoFox Rider Experiences is entirely voluntary and you do so at your own risk. MotoFox is not liable for any injury, illness or losses while taking part in the activity expect those directly caused by the our negligence, this includes indirect or consequential losses that may be incurred as a result of joining a MotoFox Experience.

are aware that the Activities in addition to the usual dangers and risks inherent has certain additional dangers and risks, some of which may include: physical exertion for which you may not be prepared; weather extremes subject to sudden unexpected change; remoteness from normal medical services; evacuation difficulties if you are injured.

acknowledge that the enjoyment and excitement of adventure travel is derived in the part from the inherent risks incurred by riding a Vehicle/ Motorcycle through the less well developed countries listed on the itineraries and undertaking activities beyond the levels of safety normal at home or at work, and that these inherent risks contribute to such enjoyment and excitement and are the reason for your participation.

acknowledge that the nature of this type of travel requires a considerable degree of flexibility and you must allow for alternatives, some of which may include: not arriving at the day’s final destination; having to take an alternative road / route; a change in hotel accommodation; the group assisting each other through an unforeseen challenge which delays our schedule. The decision of the Activities Leader is final in this and you agree to comply with such decision.

understand that the route, schedules, itineraries, amenities and modes of transport may be subject to alternation without prior notice due to local circumstances or events, such as sickness, mechanical breakdown, flight cancellations, strikes, events emanating from political dispute, entry or order difficulties, climate and or other unpredictable or unforeseeable circumstances.

acknowledge that the countries that we travel in are, for the some part may be, underdeveloped, both as far as basic infrastructure are concerned, and in the level of amenities. Nor do they lend themselves to creature comforts unless stated otherwise. It is important to understand that even the most meticulously planned arrangements can, and do, go wrong. Conditions are such that there may be times of discomfort and delays, which are a way of life. Participants booking on Activities implicitly accept the above.

accept that you must be of a competent skill level to complete the Activities which you have booked. The level of challenge difficulty will be clearly marked in our brochure/website to allow you to make an informed decision when booking. Nevertheless it is your responsibility to ensure you have sufficient riding skills (and the necessary license and equipment) to comfortably complete the Activities you have booked. If, in the Activities Leader’s reasonable opinion, you are not of a competent enough skill level to complete the Activities, you may be asked to leave the Activities to ensure the safety of yourself and the other Participants, and MotoFox Rider Experiences shall have no further liability to you (and no refund shall be payable). The Activities Leader’s decision in this regard shall be final.

accept that you, your baggage and property travel entirely at their own risk, acknowledging that participating in an Activities means that certain risks will occur, including but not limited to the hazards of the chosen activity, of travelling through mountain terrain at altitude, the forces of nature and the very limited medical facilities of some regions.

realise that attitudes to safety are very different to those in Western Europe. Passenger seat belt regulations or minimum standards of vehicle maintenance or driving standards are not widely enforced. Hard hats, helmets, life jackets may not be provided for activities. You must accept all the consequences of such a different lifestyle, culture and attitudes, which may be adverse to your own well-being.
Nothing in these Booking Conditions does or is intended to exclude our liability for death or personal injury as a result of our negligence.

8. Itineraries
​
a) The itineraries and other details are published in good faith. The running times are estimates only and we will not be liable for any loss (howsoever caused) arising from the delay to operate services in accordance with published timings.
b) If any additional expenses are incurred by the Participant(s) through delays, accidents or disruption in planned itineraries because of force majeure, or are considered advisable by us, then these are borne by the Participant(s).
c) The Participant(s) accept that force majeure may prevent MotoFox Rider Experiences from supplying the Activities as described and MotoFox Rider Experiences shall have no liability in this regard.
d) No refund will be made for any unused services which are included in the Activities Price.

9. Pre-Departure Meeting
​
For some of our Activities, we have a pre-departure meeting with the Participants where you can ask us any questions you might have about the Activities, meet some of the other Participants and meet us and our team. You may also have the opportunity to demonstrate your motorcycling skills. By offering any comments or advice on your motorcycling skills, this is not an assurance nor a confirmation on our part that you will be capable and competent enough to complete the Activities, and it remains your sole responsibility to ensure your motorcycling skills are competent enough for the Activities you have chosen.
Failure by you to attend a mandatory pre departure meeting will result in your removal from the activities, no refund or recompense will be available to you should this happen. Details of any mandatory predeparture meeting(s) will be available at the point of booking.

10. Activities Leader
​
Our Activities are accompanied by a Activities Leader, Guide, Instructor or Assessor depending on the course or activity you have chosen. The decision of the Leader is final on all matters likely to affect the safety or well-being of any Participant, including the competency of any Participant, any change in itinerary due to unforeseen circumstances or the removal of a Participant from the Activities. If you fail to comply with a decision made by the Activities Leader, or interfere with the well-being of the group, the Leader may order you to leave the Activities immediately, with no right of refund. In such a circumstance, where a Participant is removed from the trip they will be escorted to the nearest accessible road and will be responsible for making their own onward arrangements. Their designated emergency contact will be informed that they are no longer under our duty of care.
MotoFox Rider Experiences have no financial obligation to any participant who has been removed from an activity by guide, instructor or assessor for breach of these terms, antisocial, dangerous or illegal actions, including but not limited to any onward or return travel arrangements and refunds, unless we are shown to have been legally negligent..
MotoFox Experiences are self-supported. Our guides/ instructors facilitate the journey and itinerary, but they do not provide personal support for dressing, gear management, motorcycle maintenance or packing. For those seeking a fully supported, all-inclusive adventure, please research other specialized providers.

11. The Participant(s) Responsibilities for overseas and UK trips using (Vehicle/ Motorcycle)
​
a) The Participant(s) must have in their possession during the Activities the following documents which must be current and valid and are in respect of their vehicle and the Participant(s).
Passport, valid for six months after the end date of the trip.
Driving licence of the Participant(s) country of residence.
International Driving Permit
Vehicle registration document and / or title (where applicable)
Carnet de passage (where applicable)
Vaccination certificates (where appropriate)
Personal travel insurance, valid for licence for your Vehicle/ Motorcycle and appropriate for the capacity of the engine and covering personal accident, medical expenses, repatriation, loss and damage to personal effects. In the event that the Participant(s) do not have suitable travel insurance, they will not be allowed to join the Activities.
b) It is the Participant’s responsibility to make all necessary arrangements to ensure compliance with visa requirements for each country, and we accept no responsibility whatsoever in the event that these matters are not dealt with prior to departure. Participants who are forced to curtail their participation due to incorrect, lack of or loss of necessary documents will not be refunded.
c) The Participant(s) accepts responsibility for obtaining all necessary travel information and documentation required for the Activities. Any information that we provide to the Participant(s) on such matters as permits, visas, vaccinations, climate, clothing, baggage, special equipment etc, whether done before the start or during the Activities, is given in good faith but without any responsibility whatsoever on the part of MotoFox Rider Experiences.
d) It is the Participant(s) responsibility to ensure that they seek professional medical advice before travelling and to take all necessary health precautions and preventative measures. The Participant(s) must inform us of any medical, physical, mental or other condition, which may affect the services provided on the Activities, including any condition which may arise en route.
e) In booking a Activities, the Participant(s) acknowledge that they are responsible for making themselves aware through their country’s Foreign Office, State Department warnings, advisers and other sources available to them, in regard to the safety of the countries and areas in which they will be travelling and to make their own decisions accordingly.
f) If Participant(s) provide their own equipment it must be suitable for the Activities itinerary. The Participant(s) are solely responsible for the condition of their equipment and that it is safe for use. Your Vehicle/ Motorcycle/ equipment must be in good legal condition. In the event of a mechanical failure, all additional costs associated with the repair of the equipment/Vehicle/ Motorcycle are the responsibility of the Participant(s).
g) Participant(s) are responsible for the provision of their PPE rider equipment and kit and the wearing of a helmet is mandatory for all riding when on Activities.
h) Participant(s) are responsible for the use of the Vehicle/ Motorcycle (whether hired from a third party or using their own Vehicle/ Motorcycle) and how they ride it and they must conform to local laws and regulations. They are also responsible for any pillion passenger being carried. A road traffic accident that occurs to Participant(s) causing personal injury or death is not the responsibility of MotoFox Rider Experiences or the Activities Leader or support team, unless we are shown to have been legally negligent.
i) By accepting the terms and conditions via click wrap, the Participant(s) agree to accept the authority and decisions of our Activities leader, employees, agents or suppliers during the Activities. Participants must follow any the instructions provided to them in the Activities Departure Handbook. If, in the opinion, of any of these people, your health or conduct appears to endanger the progress of the Activities you may be excluded from the whole or part of the Activities.
j) The Participant(s) must abide by all local laws and customs of the countries visited, including but not limited to Vehicle/ Motorcycle clothing and equipment, condition of their Vehicle/ Motorcycle, traffic regulations, the Participant(s) ability to ride the Vehicle/ Motorcycle and all other laws. Responsibility for legal compliance rests with the participant, MotoFox does not offer any legal advice regrading to the laws that apply for any territory travelled on a MotoFox Experience. In the event that the Participant(s) are stopped or held by the local authorities, the consequence of this remains the Participant(s) responsibility and we will not be able to unduly delay any part of the Activities. MotoFox Rider Experiences has the absolute discretion to order a Participant to leave the Activities if they are found contravening such laws and customs, or interfering (or is judged to have the potential to interfere) with the well-being of the group, other Participant(s) or themselves, or they are putting the progress of the Activities in jeopardy.
k) The Participant also expressly understands that they are under a duty to mitigate any risks to themselves as far as is practicable, by taking all reasonable steps to ensure their own safety whilst on the Activities.
l) We will not be able to assist the Participant(s) to the detriment of the other Participants of the Activities. The Participant(s) may re-join the Activities at any time, provided they are fit to do so. Should a Participant leave a Activities prior to the end, for whatever reasons, no refund will be made.
m) The Participant(s) must be aware that we may take photographs, videos and films of the Participant(s) whilst on the Activities, of which we reserve the right to use such material for any advertising, brochures and video production, and other marketing uses (including footage for television) without obtaining further consent.

12. Your Behaviour
​
a) All Participants are expected to conduct themselves in an orderly and acceptable manner and not to disrupt the enjoyment of other clients. If in our opinion or in the opinion of any hotel manager or any other person in authority, your behaviour or that of any member of your party is causing or is likely to cause distress, danger or annoyance to any of our other guests or any third party or damage to property, or to cause a delay or diversion to transportation, we reserve the right to terminate your booking arrangements with us immediately.
b) In the event of such termination our liability to you and/or your party will cease and you and/or your party will be required to leave your accommodation or other service immediately. We will have no further obligations to you and/or your party. No refunds for lost accommodation or any other service will be made and we will not pay any expenses or costs incurred as a result of termination. You and/or your party may also be required to pay for loss and/or damage caused by your actions and we will hold you and each member of your party jointly and individually liable for any damage or losses caused by you or any member of your party.
c) Full payment for any such damage or losses must be paid directly to the hotel manager or other supplier prior to departure from the hotel. If you fail to make payment, you will be responsible for meeting any claims (including legal costs) subsequently made against us as a result of your actions together with all costs we incur in pursuing any claim against you.
d) We cannot be held responsible for the actions or behaviour of other guests or individuals who have no connection with your booking arrangements or with us.

13. Insurance
​
Adequate travel, motor and breakdown insurance is a condition of your contract with us. You must be satisfied that your insurance fully covers all your personal requirements including cancellation charges, medical expenses and repatriation in the event of an injury due to an accident on your Vehicle/ Motorcycle or otherwise or illness and existing medical conditions. Your insurance must also cover you to undertake motorcycling activities and the associated risks. If you choose to travel without adequate insurance cover, we will not be liable for any losses howsoever arising, in respect of which insurance cover would otherwise have been available.

14. Disabilities and Medical Problems​​​
​
a) If you or any member of your party has any medical problem or disability which may affect your stay, please provide us with full details before we confirm your booking so that we can try to advise you as to the suitability of your chosen arrangements. We may require you to produce a doctor’s certificate certifying that you are fit to participate in the Activities. Acting reasonably, if we are unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking or if you did not give us full details at the time of booking, we will cancel it and impose applicable cancellation charges when we become aware of these details.
b) You must be adequately fit to cover the challenges/ activities and undertake the program set out in your itinerary. If it is felt that any Participant is not sufficiently fit, healthy, properly equipped or able to complete the Activities without affecting its safety, comfort or happy progress, the Activities Leader at any stage has the right to remove you from the Activities.
c) Medical Treatment: It is a condition of joining a Activities that in cases of emergency we have your authority to arrange any necessary medical or surgical treatments and to sign any required form of consent on your behalf.​

15. Our Responsibilities
​
We will accept responsibility for the arrangements we agree to provide or arrange for you as an “organiser” under the Package Travel, Package Holidays and Package Activities Regulations 1992 as set out below. Subject to these booking conditions, if we or our suppliers negligently perform or arrange the services which we are obliged to provide for you under our contract with you, as set out on your confirmation invoice, we will pay you reasonable compensation. The level of such compensation will be calculated taking into consideration all relevant factors such as but not limited to: following the complaints procedure as described in these conditions and the extent to which ours or our employees’ or suppliers’ negligence affected the overall enjoyment of your holiday. Please note that it is your responsibility to show that we or our supplier(s) have been negligent if you wish to make a claim against us.
We will not be responsible or pay you compensation for any injury, illness, death, loss, damage, expense, cost or other claim of any description if it results from:-
a) the act(s) and/or omission(s) of the person(s) affected;
b) the act(s) and/or omission(s) of a third party unconnected with the provision of the services contracted for and which were unforeseeable or unavoidable;
c) unusual or unforeseeable circumstances beyond ours or our supplier(s) control, the consequences of which could not have been avoided even if all due care had been exercised; or
d) an event which either ourselves or suppliers could not, even with all due care, have foreseen or forestalled.
We limit the amount of compensation we may have to pay you if we are found liable under this clause:
(a) loss of and/or damage to any luggage or personal possessions and money:
The maximum amount we will have to pay you in respect of these claims is an amount equivalent to the excess on your insurance policy which applies to this type of loss per person in total because you are assumed to have adequate insurance in place to cover any losses of this kind.
(b) Claims not falling under (a) above and which do not involve injury, illness or death:
The maximum amount we will have to pay you in respect of these claims is twice the price paid by or on behalf of the person(s) affected in total. This maximum amount will only be payable where everything has gone wrong and you or your party has not received any benefit at all from your booking.
(c) Claims in respect of international travel by air, sea and rail, or any stay in a hotel:
i) The extent of our liability will in all cases be limited as if we were carriers under the appropriate Conventions, which include The Warsaw/Montreal Convention (international travel by air); The Athens Convention (with respect to sea travel); The Berne/Cotif Convention (with respect to rail travel) and The Paris Convention (with respect to hotel arrangements). You can ask for copies of these Conventions from our offices. Please contact us. In addition, you agree that the operating carrier or transport company’s own ‘Conditions of Carriage’ will apply to you on that journey. When arranging transportation for you, we rely on the terms and conditions contained within these international conventions and those ‘Conditions of Carriage’. You acknowledge that all of the terms and conditions contained in those ‘Conditions of Carriage’ form part of your contract with us, as well as with the transport company and that those ‘Conditions of Carriage’ shall be deemed to be included by reference into this contract.
ii) In any circumstances in which a carrier is liable to you by virtue of the Denied Boarding Regulation 2004, any liability we may have to you under our contract with you, arising out of the same facts, is limited to the remedies provided under the Regulation as if (for this purpose only) we were a carrier.
iii) When making any payment, we are entitled to deduct any money which you have received or are entitled to receive from the transport provider or hotelier for the complaint or claim in question.
It is a condition of our acceptance of liability under this clause that you notify any claim to us and our supplier(s) strictly in accordance with the complaints procedure set out in these conditions.
Where any payment is made, the person(s) receiving it (and their parent or guardian if under 18 years) must also assign to ourselves or our insurers any rights they may have to pursue any third party and must provide ourselves and our insurers with all assistance we may reasonably require.
Please note, we cannot accept any liability for any damage, loss or expense or other sum(s) of any description: (a) which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you; or (b) relate to any business.
We will not accept responsibility for services or facilities which do not form part of our agreement or where they are not advertised in our brochure. For example any excursion you book whilst away, or any service or facility which your hotel or any other supplier agrees to provide for you.

16. If we cancel or change any Activities
​
Commercial Viability: We reserve the right to cancel the Participant(s) booking if there are not sufficient numbers on the Activities to make it commercially viable. We will provide the Participant(s) with a minimum three (3) months notice. In such circumstances the Participant(s) options are:
a) a full refund of all monies paid
b) transfer onto an alternative Activities (which may involve an additional payment or refund)
c) continue on original Activities, on payment of a supplement.
Significant Changes and Outright Cancellation: From time to time, we may have to make minor changes to the Activities, of which we are not obliged to inform the Participant(s) prior to departure. In the rare circumstances, where we need to make a significant change, we will notify the Participant(s) as soon as reasonably possible prior to departure. “Significant” changes are considered to be not visiting more than one of the main cities or highlights listed in the itinerary and all other changes are defined as minor changes. There may also be rare unforeseeable circumstances, which mean that the Activities has to be cancelled outright and we reserve the right to do so.
In the event of a significant change or outright cancellation of the Activities, the Participant(s) have the following options:
a) where there is a significant change, continue the Activities as per the new details / itinerary
b) transfer to an alternative available Activities (which may involve an additional payment or refund)
c) a full refund of all monies paid
If the Activities is cancelled, MotoFox Rider Experiences will not be liable for additional costs or losses incurred by Participant(s) due to the cancellation of the Activities. This includes, but is not limited to, the cost of prepaid airline tickets, ferry tickets, hotel reservations or car rental costs. Participants should not book such arrangements until they receive written notification from MotoFox Rider Experiences that the Activities will proceed as planned.
For significant changes or outright cancellation of Activities, with less than three (3) months notice, we will compensate the Participant(s) with the sum of £100 per Participant. No other claims for compensation or expenses will be considered. The Participant(s) will not be offered any compensation if we provide notification in excess of the timescales stated above. Please note: where accommodation with a higher price than the original accommodation is offered by us and accepted by you, the difference in price will be deducted from any compensation payable. In no case will we pay compensation if accommodation is offered by us and accepted by you with a higher price than that originally booked in the same location where no additional payment is made by you.
Very rarely, we may be forced by “force majeure” (see clause 22) to change or terminate your arrangements after departure. If this situation does occur, we regret we will be unable to make any refunds (unless we obtain any from our suppliers), pay you compensation or meet any costs or expenses you incur as a result.
If we become unable to provide a significant proportion of the services that you have booked with us after you have departed, we will make alternative arrangements for you at no extra charge and, if appropriate in all the circumstances, will pay you reasonable compensation.

17. If Participant(s) cancel
​
It is important that we protect the viability of the Activities to ensure that Participants who do not cancel are protected from lower numbers in the event others do cancel. Your Activities Deposit is non-refundable. Your final payment is due on the first day of the calendar month prior to departure or upon booking for activities where 2 or less nights accommodation is provided. Once this amount has been paid, there is no refund if you then cancel.

18. Transfer of Booking
​
If the Participant(s) are prevented from travelling on any international activity for any reason, they may transfer the booking to another person, subject to written consent given by MotoFox Rider Experiences, provided that notice is given before the first day of the Calendar month prior to departure and the new Participant fulfils the necessary requirements to join the Activities, including but not limited to the completion and signing of a booking form and a release and waiver document, as well as payment of a £100 administration charge.
After having paid a deposit and / or stage payments for a trip, if a Participant wishes to transfer to an alternative Activities for whatever reason, this is treated as a cancellation of the original Activities and a new booking for the alternative Activities. Any payments made are specific to a Activities and are non-refundable and non-transferable to another Activities.

19. Conditions of Suppliers
​
Many of the services which make up your activity are provided by independent suppliers. Those suppliers provide these services in accordance with their own terms and conditions Those suppliers provide these services in accordance with their own terms and conditions which will form part of your contract with us. Some of these terms and conditions may limit or exclude the supplier’s liability to you, usually in accordance with applicable International Conventions. Copies of the relevant parts of these terms and conditions are available on request from ourselves or the supplier concerned.

20. Transport Delays
​
f you or any member of your party misses your flight or other transport arrangement, it is cancelled or you are subject to a delay of over 3 hours for any reason, you must contact the airline or other transport supplier concerned directly and immediately. As we do not offer flights or other transport as part of our package, we have no liability whatsoever to you in respect of any such delays or cancellations. Any airline or other transport supplier may however pay for or provide refreshments and/or appropriate accommodation and you should make a claim directly to them.

21. Prompt Assistance during the Activity
​
The Package Travel Regulations 1992 provide that in the event that you experience difficulty which is not owing to any fault on our part or which is due to unusual or unforeseeable circumstances, we will provide you with prompt assistance. Where you experience a delay which is not owing to any failure by us, our employees or sub-contractors, this prompt assistance is likely to extend to providing help in locating refreshments, accommodation and communications but not paying for them. Any airline or other transport supplier may however pay for or provide refreshments and/or appropriate accommodation and you should make a claim directly to them. Subject to the other terms of these conditions, we will not be liable for any costs, fees or charges you incur in the above circumstances, if you fail to obtain our prior authorisation before making your own travel arrangements.

22. Force Majeure
​
Except where otherwise expressly stated in these booking conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by any event which we or the supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid. These events can include, but are not limited to war, threat of war, civil strife, terrorist activity and its consequences or the threat of such activity, riot, the act of any government or other national or local authority including port or river authorities, industrial dispute, lock closure, natural or nuclear disaster, fire, chemical or biological disaster and adverse weather, sea, ice and river conditions and all similar events outside our or the supplier(s) concern’s control. Advice from the Foreign Office to avoid or leave a particular country may constitute Force Majeure.

23. Complaints

If the Participant(s) have a complaint about the Activities, in the first instance the Participant(s) must inform the Activities leader so that remedial action can be taken if possible. Thereafter, the Participant(s) must make the complaint in writing within the first 30 days of the Activities finish date, sending it to: MotoFox Rider Experiences Limited Failure to follow the procedure set out in this clause may affect ours and the applicable supplier’s ability to investigate your complaint, and will affect your rights under this contract.

​​24. Indeminty
You agree to indemnify and hold MotoFox, its guides, employees, and contractors harmless from and against any loss, damage, liability, claim, or expense (including reasonable legal fees) arising out of or in connection with your participation in any MotoFox activity, to the extent that such loss or damage is caused by your negligence, reckless behaviour, or breach of these Terms. This includes, without limitation, any third-party claims resulting from your actions while riding.

25. The Participant

All riders must complete individual booking forms.

All rides start with an informal riding assessment, please ensure your ability matches the descriptions of the ride. We highly recommend that if you are usure of where your abilities lie you book on to an easier ride first. As a guidance our of tarmac activities are rated on a colour coded system.

Green - I am competent on Surfaced Roads and am ready​ try off tarmac riding.

Blue - I have done some trail riding, I accept that there may be some technical challenges.

Red - I am a competent and regular trail rider and am happy to ride most terrain.

You must be fit enough in body and mind to participate in the activity. Please declare all health conditions, allergies or medications on the registration form, even if you think it is under control or a minor condition we would rather know. If applicable please carry any medication you may need to during the activity, please let you guide know where it is should it be needed during the activity. In certain circumstances you may be asked to get a certificate of fitness from your doctor before joining an experience.

Water - You must carry water with you during the activity, especially during hot days we recommend a minimum of 2 litres.

​Alcohol and Drugs - if you appear to be under the influence of any substance that may impair your abilities you will be prevented joining the ride, on multi day adventures excessive drinking in the evening causing a "hangover" may result not being able to join the ride the next day. If this incurs additional expenses these will be passed on.

​Locks - On multi day experiences parking may be in an unsecured location. Please make sure you have appropriate security for your machine at lunch or overnight stops. MotoFox guides are not responsible for the security of clients property.

PPE: The following Items of PPE are mandatory and you may not be permitted to join the experience without wearing the following Items:

An ECE 22.05 or ECE 22.06 rated motorcycle helmet

Sturdy motorcycle clothing with armour at the shoulders, elbows and knees. MotoFox also recommends back and hip armour.

Suitable protective gloves.

Clothing suitable for the prevailing weather. On multi day or international trips please ensure you are prepared for temperature and weather changes through our the trip. If your experience involves riding at various altitudes, hill or mountain ranges be prepared that cold and inclement weather can occur with little notice at all times of year.

If you are unsure if you have appropriate clothing for your experience we recommend contacting us before booking.

If you fail to bring weather appropriate clothing on your experience MotoFox reserves the right to pass on any compensation claims from other participants who have their experience impacted.

26. The Motorcycle (if provided by you or hired from a 3rd Party)

Your motorcycle must be in a roadworthy state, Insured, taxed and have a valid MOT certificate. By joining a MotoFox ride you consent that the guide may check your Insurance, MOT and Tax status of the vehicle and perform a visual check of the machine before you are accepted on the the ride.

Please note although our guides may visually check your machine to check for obvious or dangerous defects. This does not, however, certify your machine as roadworthy or diminish your responsibilities as the operator for maintaining roadworthiness.

If you fail to bring a road worthy or appropriate motorcycle on your experience MotoFox reserves the right to pass on any compensation claims from other participants who have their experience impacted.

All participants must hold the correct license for the machine they are riding and have suitable insurance to take part in the activity. Please bring evidence of this with you on the day in the form of your driving license and online driving license record which can be found here.

All collisions or incidents that occur during a MotoFox experience will be treated as standard road collisions. Liability and any subsequent claims should be managed through the motor insurance policy of the vehicles involved. It is essential to ensure that your motor insurance adequately covers you for the activities you are participating in review your policy to confirm your coverage.

The participant indemnifies MotoFox for any damage caused by their negligence, or third-party claims arising from their riding.

MotoFox Guides are not mechanics, in the event your motorcycle suffers a mechanical issue and you can't get it running, your guide will do everything feasible for you to be rescued from a place of safe refuge by a breakdown company. It is required that you have breakdown cover for your bike on when booking onto a MotoFox Experience.

MotoFox guides are not responsible for the maintenance and care of customers machinery.

27. Bike Hire:

You must be over the age of 25 to hire a motorcycle from MotoFox..
-
You must hold either a Category A2 or a Full Category A Motorcycle license. Riders from outside the UK/ EU must have a full motorcycle license. If you are unsure if you are licensed to ride in the UK please check here.

If Hiring a Motorcycle from MotoFox you must bring with you both you driving license and a license summary (dated no more than 21 days before the activity), you can obtain a license summary here. International licenses do not have to bring a license summary.

You are not permitted to ride a MotoFox motorcycle with out supervision from a MotoFox Guide.
-
Prior to the experience MotoFox will charge a balance of £500 from a debit or credit card, this will be used to pay for any damage or loss of income that may occur to the Motorcycle beyond wear and tear particularly if this caused by rider negligence. This will be refunded at the end of the day should the bike be returned in the same condition it was hired in. Please make sure you have a payment method with enough balance prior to arrival.

Wear and Tear includes consumable parts such as chains, tyres break pads that would normally wear away during the course of the ride.​

Negligence is includes but is not limited to: a deliberate act by the rider, a decision that goes against the guides advice, attempting a manoeuvre or action that is not within the riders abilities or riding too fast for the abilities of the rider on the terrain at the time.

You will be given the opportunity to inspect the motorcycle before use please draw any defects to your guide/ instructor.

You must obey the highway code at all times when on a MotoFox rider experience any penalty points picked up whilst riding a MotoFox machine will be passed on the rider.

If your riding ability is not deemed up to standard by our guide you may find your ride terminated with out refund.
-
If your riding is deemed dangerous, illegal or antisocial buy the guide then your ride may terminated without refund.

You must be of physical stature and ability to ride a Motorcycle with a seat height of 920mm to hire a Voge 300 Rally or 835mm to hire a Hero Xpulse 200.​

If you are unsure of your ability to manage the seat height of the motorcycle you wish to hire you may arrange a trial on the bike at time mutually convenient to both the participant and MotoFox Rider Experiences.

The Location of this trial will be at Warmley Shipping Containers, Tower Road South, Barrs Court, Bristol, BS30 8BT.

You should arrange and complete your trial prior to making you booking.

MotoFox will not pay refunds or recompense if you make a booking and are unable to handle the motorcycle you have hired.

MotoFox is responsible for presenting a hire bike in roadworthy condition including:

A motorcycle free from defects that affect it's roadworthiness.​

A motorcycle insured for the purposes of the activity.
-
A motorcycle with Valid Road Tax and MOT if applicable.

28. Media And Public Relations
Please be aware any visible slogans or emblems that may be interpreted as discriminatory or politically motivated are not permitted on MotoFox experiences, if you turn up with anything displayed you may be asked to remove or cover it before joining the ride.
During the event MotoFox reserves the right to take photos or video that may be used for promotional activities in the public domain. By participating in the event you agree to waive any image rights and agree to photos and videos that may include yourself being shared in the public domain.
